The case had been moving toward trial after a Brussels court ruled in March that Davignon should face proceedings. He was accused of involvement, in a diplomatic capacity at the time, in actions related to Lumumba’s detention and transfer, and of contributing to denying him a fair and impartial legal process. Davignon denied all allegations.
The Lumumba family has stated that the legal process remains significant as part of the historical record and has indicated plans to pursue further civil action against the Belgian state.
Patrice Lumumba, who became the first prime minister of an independent Congo in 1960 following the end of Belgian colonial rule, was removed from office within months and executed in early 1961 at the age of 35. While Congolese actors carried out the killing, long-standing allegations have pointed to possible foreign involvement or complicity.
A Belgian parliamentary inquiry in 2001 concluded that Belgium bore “moral responsibility” for Lumumba’s death, a finding later acknowledged by an official government apology. In 2022, Belgium returned a gold-capped tooth believed to be part of Lumumba’s remains to his family.
Davignon had been among several Belgian nationals previously named in the broader investigation, which also included allegations of mistreatment, unlawful transfer, and denial of fair trial rights.
